We had the pleasure of representing a client whose brand new Cadillac sustained damages as a result of the negligence of a valet company. Our office attempted in good faith to resolve this matter with the valet company and in an effort to avoid litigation. The valet company simply refused to address the most important element of the claim…diminished value. Our client’s new Cadillac, with a mere 5500 miles on it, was worth considerably less following it’s collision with the concrete corner of the parking garage, then its value the day before this incident. In fact, our expert determined that the cost to repair the vehicle, while at about $5400, sustained a diminished value of just over $10,000. As a result of many factors, our expert, Duane Wilson, of North Florida South Georgia Appraisals, testified about how diminished value is calculated in Florida. The judge agreed with our expert, awarding a total of $14,998.00, from the bench against the valet company.
