What is product liability?

Everything that we purchase is not guaranteed to be accident-proof. However, manufacturers and distributors are required to have certain standards to ensure the safety of the consumers of their products. Thus, “product liability” is a concept that holds anyone that makes products readily available to the public (manufacturers, distributors, suppliers, retailers, etc.) responsible for any injuries that may be caused by a defective product.

In order to have a valid claim, you must be able to show that not only was the product defective, but that the defect caused your injury. If you are unsure if your claim could be valid, consult a personal injury attorney.

Product liability claims typically fall into three categories:

Manufacturer Defect: This is the most common cause of product liability claims. It is a defect that is caused during the course of a product’s manufacture or assembly. An example of a manufacturer defect could be an electronic product overheating and sparking because the wiring was not installed properly by the manufacturer.

Design Defect: A product with a design defect is inherently unsafe, as the cause of the unsafe nature of the product is not caused by an outside force such as the manufacturer. The cause of the danger is within the design of the product, present from the very beginning. An example of a design defect could be a desk collapsing on a person because it was not designed with proper support on all four ends.

Warning or Label Defect: The product can be the source of inherent danger and the manufacturer had a legal duty to give a warning of this danger, but failed to do so. An example of a warning or label defect could be a prescription medication that didn’t clearly state a major side-effect.

It is important to understand the difference between the different types of product liability claims and to understand if you are truly able to show the product was defective AND it was this defect that caused your injury. A personal injury attorney in Jacksonville, FL can help you review your situation and also make sure that you are rightfully compensated for your injury caused by a defective product.
