Why You Need a Criminal Defense Lawyer

The trouble with those who are unfamiliar with the law and legal proceedings is that it can be challenging to know when to call a criminal defense attorney. After all, not everyone expects that they will end up under investigation for one crime or another. That being said, if you do suspect that the possibility exists that you might be charged for a violation of the law, you should definitely consult a legal professional. 

The Trouble With Questioning

You might think that the police taking you in for a few questions or a statement might not be such a big deal, but anything you say might be used against you as evidence. 

Police officers and investigators are specially trained to elicit responses that are as incriminating as possible. No matter how innocuous you think the questions or your statement might be, there is no telling how it will be used over the course of the investigation. 

What complicates this further is that police officers are only required to inform you of your Miranda rights while you are in custody. Not every circumstance means they have to inform you that you can have an attorney present while giving your statement. 

Call a Criminal Defense Attorney

If the police want to talk to you, call a criminal defense attorney. You might think that it might seem a little suspicious to the police that you are requiring the presence of a lawyer during their questioning, but this is not something that a judge is permitted to consider, or a jury is permitted to know.  

Criminal defense attorneys have the training and experience to analyze the line of questioning from a police officer or investigator. The presence of a lawyer can serve as protection, as they can interject on your behalf if a specific question is designed to draw out an incriminating response. 

Search and Arrest Warrants

In the event that police have been granted a warrant to search your premises, make sure to gain a copy of the warrant. More often than not, police will attempt to expedite the process to make sure that they do not miss any evidence. That being said, it is important to call an attorney as soon as possible so that they can examine if any of your constitutional rights were violated during the search. 

If you have been placed under arrest and are in police custody for questioning, on the other hand, it is important that you immediately request to have your lawyer present. You are fully within your legal rights to deny answering until you have adequate representation by your side.
