What to Do If You’re Injured on the Job in Florida

June is National Safety Month, a timely reminder of the importance of staying safe at work and knowing what to do if something goes wrong. If you’re injured on the job in Florida, the steps you take immediately after your accident can make a big difference in protecting your rights and your benefits.

1. Report the Accident Immediately

Let your employer know about the injury as soon as possible. Delays in reporting often create complications with your claim, including delays in medical treatment or benefits.

2. Make Sure a Notice of Injury is Filed

This is the formal document that alerts the workers’ compensation insurance carrier about your injury. Without it, the insurer may deny your claim altogether.

3. Get Medical Treatment Through the Authorized Provider

Workers’ compensation in Florida is a “closed system,” meaning you must see the doctor selected by your employer or their insurance company. You cannot be treated by your regular primary care physician unless specifically authorized.

4. Submit Medical Bills Directly to the Carrier

Make sure your workers’ comp insurance—not your health insurance—is billed for your treatment. If you receive a bill, send it promptly to the carrier for payment or reimbursement.

5. Keep Your Contact Information Updated

Most communication from the insurance company—like appointment notices or schedule changes—will come by email or text. Missed appointments can be seen as “non-compliance,” which may put your benefits at risk.

6. Know the Waiting Period for Lost Wages

Florida law imposes a 7-day waiting period before you can receive lost wage (indemnity) benefits. If your disability lasts more than 21 days, you’ll be eligible to receive payment for that initial week as well. Keep in mind that workers’ compensation does not pay for pain and suffering.

7. Call Us with Questions or Concerns

Navigating the workers’ compensation system can be frustrating and confusing. If you’re unsure whether you’re receiving all the benefits you’re entitled to—or if you run into issues with your claim—contact the workers’ compensation team at Harris Guidi Rosner. We’re here to help.
